Fest (Brew Fest) Contract Conditions
1. Each
participating company is strictly
limited
to two event passes, and all names must be submitted no later than
ten days prior to the event. All
attending
company reps must have ID, business card, or employment
documentation. Company reps who choose to drink at the festival
agree to use moderation and maintain a professional composure.
2. Brew Fest Management Company (Brewtopia Events LLC - referred to as
"Brewtopia" henceforth) reserves the right to decline
or
prohibit any exhibit, Exhibitor (brewery, distributor, or importer), or
proposed
exhibit or Exhibitors not approved by the Management, and to permit
only
such matter and conduct as will be approved by Management. Booth
content
and presentation will conform to show standards established by Brew
Fest,
Brewtopia, and Foundry Park. Brewtopia reserves
the
right to decide the location of each Exhibitor's booth.
3. It is fully understood that the above named event (Brew Fest),
its
sponsors, Brewtopia, Foundry Park, and Athens Humane Society will be held harmless and are in no way responsible for any
damages
or losses to any property exhibited or used in exhibiting by the
Exhibitor.
It is the sole responsibility of the Exhibitor to cover such losses or
damages
with their own insurance.
4. Brewtopia and Athens Humane Society agrees to staff booth with trained, volunteer
pourers during all hours
the
show is open. Distributors and brewery reps are not allowed to
pour
beer samples to the public. Brew Fest volunteer pourers cannot
pour
more than two oz. samples at a time.
5. Brewing company, importer, or Exhibitor is solely
responsible for
making
sure that sufficient fresh product is available at their Athens, GA
distributor
for donation to the
event through 501-C license of the Athens-Area Humane Society.
6. Any beer or other beverages remaining at the end of the Brew
Fest is the property
of Athens Humane Society. Remaining
beer is not to be
removed nor given
to consumers or staff.
7. All decorations, for sale items, or promotional items that are
abandoned
by Exhibitors after the Brew Fest become the property of Brewtopia
unless
Exhibitor provides return UPS postage to Brewtopia.
8. In case the premises are destroyed by fire or elements, or by
any
other cause, or in case of any circumstances whatsoever, including
strikes,
making it impossible for the Management to permit any Exhibitor to
occupy
the premises, Brewtopia, Brew Fest, Foundry
Park,
and any charities are released from any and all claims for damage which
might
arise in consequence thereof.
9. In the event that the Brew Fest is not held, Classic City Brew
Fest, on
refunding
all moneys received from an Exhibitor, shall be released from all
claims
for damages.
10. Exhibitor agrees that all displays, handouts, and
distribution
of literature will be made inside leased space unless approved in
advance
by the Management.
11. Exhibitor will be responsible for paying Foundry Park Inn
for
electrical needs or any other special needs not provided by Brewtopia
to
all exhibitors.
12. All beer served at the Brew Fest must be obtained from Georgia
wholesale distributors and delivered to
Athens Humane Society at the Foundry
Park Inn
by these
wholesale distributors in accordance with state regulations.
13. Exhibitor shall indemnify and hold Athens-Area Humane
Society, Brewtopia,
Classic City
Brew
Fest, Foundry
Park,
designated charities,
their
owners and officers, directors and agents harmless from any and all
claims
or other liabilities arising out of the conduct of the Exhibitor or
member
of its staff whether or not such conduct was performed in the promoting
of
its product to the public. The Exhibitor shall hold Brewtopia and
Foundry
Park
Inn
harmless from
any
and all liability and from all costs, including attorney's fees and
other
liabilities incurred in or about any such claim action or
preceding.
This shall include product liability, employment, and operation.
